TERMS AND CONDITIONS OF USE

This document contains the Terms and Conditions for the use of the website https://ads.mybg.biz/ (“Site”) and sets out the conditions under which any natural or legal person may visit or access the Site or use, in any way, the services offered through the Site. The privacy policy displayed on the Site is an integral part of the “Terms and Conditions”.

The ads.mybg.biz website is the property of BALKANIA OFFICE SRL, registered in MUNICIPIUL BUCURESTI, Sector 2, Bucharest, Strada Corbeni 37, Ap. 5, Mansarda, CUI RO 28654528, hereinafter referred to as BALKANIA OFFICE SRL.

For the purposes of the Terms and Conditions and Privacy Policy, we define the following terms:

“Site” – all Internet pages under the domain and subdomain mybg.biz

“Partner site” means any other website in partnership with ads.mybg.biz

Site Administrator” – personal data controller Balkania Office SRL

“Article” – the article, press release, advertorial or information that the User wishes to publish via ads.mybg.biz

“User” – any person who visits or accesses the Site and benefits from the services offered by the Site through an account created on the Site;

“Account” – the User’s ads.mybg.biz site account created by the User for the purpose of accessing certain services.

“Services” – the services requested and delivered by the User, against payment, through the ads.mybg.biz website, but not only these.

Introductory provisions

If the User wishes to access the Services, the User must create an Account.

If the User does not ensure the confidentiality of the login data, the User assumes responsibility for maintaining the confidentiality of such data and all activities carried out by third parties in the Account on behalf of the User. In the event that the User loses the login data, or it is used unauthorizedly, as well as in the event of detection of any other breach of security or confidentiality of the data in question, the User undertakes to inform ads.mybg.biz without delay by sending an e-mail to marketing@mybg.biz.

If the User does not wish to use the Account, he/she may delete it at any time by subsequently sending us a written notice to marketing@mybg.biz.

By accessing, visiting, using or purchasing the products/services/packages presented on the ads.mybg.biz Website you expressly agree to the Terms and Conditions of Use and Privacy Policy detailed below. If you do not agree to these do not continue to access the Site and do not use the Services offered by the Site in any way. If you wish to withdraw, you may at any time close your account in accordance with the provisions applicable to Users and/or no longer access or use the Services as a Visitor/User.

Description and access to Services

The Site can be accessed by persons of interest as a Visitor or, by creating an account, as a User.

Through the Site, Users have access to Services consisting of consulting, publishing, hosting and distribution of articles issued by institutions, organizations or companies in Romania both on the Site and on partner sites and social networks. Visitors have access to the information published on the Site

Create User Account

Access to use the Service is by creating a User account on the Site. When registering it is necessary to provide real and correct data in order to complete the registration form.

The registration form includes a category of Users, namely, Company.

Users who create an account on the Site in order to use the service will be obliged, upon registration, to acknowledge the provisions of the Terms and Conditions. By ticking the accept option, the User fully and unconditionally agrees to the provisions of the Agreement and agrees to use the Service in strict accordance with them. Non-acceptance of the Terms and Conditions by the above-mentioned Users entails their obligation to immediately cease accessing the Site.

Account activation

Please fill in the identification data of the company representative. Enter the company name and identification data and, if available, other required information as it appears in the company’s registration document.

After activating the account, companies have the possibility to publish articles, and the site is obliged:

to publish articles uploaded to the User’s account;
to distribute items uploaded to the User’s account;
provide access to information on the distribution of articles published by the User;
to inform the User within 24 hours of receipt of the information in case of impossibility to publish it on the agreed dates, whether it is the Site or the partner Sites;
to carry out the translation and adaptation of the text without any substantial changes to the content of the materials, excluding rewordings aimed at increasing the quality of the content of the articles, agreed by the User and formatting changes to the text.

The user who publishes articles is obliged:

to pay the amount set out and specified in each firm order in accordance with these terms and conditions;
not to publish the same article twice for the same media publication;
fully comply with the publication rules
The user will assume full civil and criminal liability for the content of the articles submitted, for the advertising materials used (including the ideas and messages contained therein) and for the content of the websites to which they submit the materials used in this campaign. The user declares and guarantees that he/she has all the necessary rights, authorisations and has obtained the consent of all persons involved for the publication of the articles and that they do not violate the rights or freedoms of third parties or the legislation in force.

The user has the right to complain about irregularities in the services covered by this contract. Complaints must be made in writing, by e-mail, within 15 days of the provision of the services and must include the following:

the subject of the complaint;
the time limit within which they were formulated;
evidence of the alleged misconduct;
the verification method to be used;
the causes of the shortcomings complained of;
how to extinguish complaints.

It is forbidden to publish articles:

who promote, advertise or are connected, in any way or to any extent, with gambling organized by companies that are not licensed in Romania or that violate, in any way or to any extent, the legal regulations in force.
infringing, in any way or to any extent, copyright or any other intellectual property rights that a third party may claim in connection with materials and information transmitted in any way to the Site or any rights belonging to third parties.

5.3. When posting articles, other material, including comments, regardless of their type, Users agree to the following limitations:

may not publish, transmit or refer in any way to messages containing illegal, threatening, abusive, indecent or violent texts;
may not collect the personal data of other Users of the Site or restrict other Users’ access to different areas or types of content/services on the Site;
may not use software, automated devices or any manual process to monitor or copy the Site pages or their content without prior written permission from the Site;
may not publish racist, xenophobic, anti-Semitic articles or material and any other kind of material that incites hatred of a certain human category, professional, etc;
may not publish articles or materials that infringe or circumvent, in any way, the legal regulations in force including, but not limited to, copyright, the rights granted to inventors, trademark owners and any other rights protected by intellectual and industrial property, the right to privacy of the person, rights conferred by a contract or other rights held by third parties;
may not publish articles or any other material that promotes, references, or uses software or services of a nature to send unsolicited email;
may not publish articles or materials that violate any provisions of national, EU or international regulatory law;
may not publish articles or material that is threatening, abusive, harassing, libellous, insulting or defamatory, obscene, profane, indecent or subject to public opprobrium;
may not use any device, including software devices or subroutines, that interferes or attempts to interfere with the proper working of the Site or the normal operation of the Services;
to take any action that imposes any unfair, unreasonable, abusive or disproportionate use of the infrastructure provided by the Site;
not to copy, reproduce, alter, modify, distribute (including by public display), use for commercial or any other purpose, the content of the Site (or any part thereof), and agree not to make any works / web pages / online services that reproduce in any way sections of the Site, without prior written permission from the Site and / or third party, as appropriate.

If the rules in point 5.1. are violated, the Site may intervene on the modification of the content, in particular concerning formatting rules, or may take the decision to refuse publication of the articles. In case of refusal, the User may choose to republish the article according to the Site’s rules or may request a refund, within fourteen days, of the price paid for the article in question.

Users understand and agree that, in the event of breach in any way and to any extent of any of the provisions of the Terms and Conditions, the Site may at its sole discretion choose to suspend all or part of the User’s access to any of the Site’s services, or for the non-publication of any content sent by the User for posting to the Site, or for the definitive prohibition of access to one or more of the facilities offered by the Site, or for the termination of the User’s account on the Site, without any prior warning or notification and without any other formalities being necessary in this respect. Users understand and accept that the Site has the right to apply the above measures, without any obligation in this regard. The price paid will be refunded within 14 days of receipt of the User’s request.

The Site may at any time run advertising campaigns and/or promotions in any section of the Site. The campaigns and promotions run by the Site do not require the consent of the Users/Visitors of the Site.

If you provide inaccurate or incomplete information, we reserve the right to suspend or terminate your account and refuse all current or future attempts to use the Service.

We reserve the right to refuse to activate an account if it is deemed inappropriate or if there is suspicion that your identity is being used by another person.

If there are suspicions about the use of your account by other persons or the use of data by other persons you are obliged to contact us as soon as possible and provide us with evidence confirming your identity. The Site Administrator does not assume responsibility for situations where your identity has been used by unauthorized persons and you have not acted in accordance with the recommendations of the Site Administrator.

We reserve the right to refuse to work with customers who display inappropriate behaviour and language (aggressive, licentious, etc.) or who have a history of past cooperation.

We reserve the right not to honor the delivery of products or services whose price is wrong and does not fit into the company’s price list. In this case, the customer will be contacted and will have the option to confirm the order at the correct price or to refuse it.

We reserve the right to make changes and updates to these terms and conditions and the offer without prior notice and without stating reasons; we also reserve the right to correct any omissions or errors in the posting that may occur as a result of typos, inaccuracies or errors in software products without prior notice. These errors do not commit us to any action.

ORDERS AND REQUESTS FOR QUOTATIONS

Requests for quotes can only be made using the contact form on this website. The user is obliged to provide accurate and as concrete data as possible about the desired project. BALKANIA OFFICE SRL cannot be held liable in any way for any inconvenience caused by the user providing incorrect or incomplete information.

If BALKANIA OFFICE SRL considers a request to be incomplete or incorrect, it may request additional details from the user using the e-mail address or contact telephone number provided by the user, or delete the request without notifying the user.

DISPUTE RESOLUTION

Disputes can be settled amicably or through the competent courts or mediators. The European Commission has implemented an online dispute resolution platform available here.

SERVICES

The contract between Balkania Office and the User for the provision of the Services shall be deemed to be concluded upon receipt of payment made in accordance with the provisions of these Rules or, if the Services are requested by a User, upon receipt of payment made in accordance with the provisions of these Rules or with the provisions of a separate contract concluded between BALKANIA OFFICE and the Commercial User.

The User pays for the Services provided by BALKANIA OFFICE.ro with credit or debit bank cards, by bank transfer, depending on the method chosen by the User. The Services will be provided to the User only after the User has paid for them in accordance with the provisions of these Rules and the conditions established by BALKANIA OFFICE.ro. As for the commercial User, the Services will be provided to him after he has paid for them in accordance with the provisions of these Rules and the conditions established by BALKANIA OFFICE.ro, or under the terms set out in a separate contract concluded between BALKANIA OFFICE and the commercial User, if one has been concluded.

The Site makes no warranties of any kind, express or implied, including, without limitation, as to the Services offered or the possibility of obtaining a specific result from the use of the Services or the information displayed.

BALKANIA OFFICE has the right to organize marketing campaigns during which Users can obtain discount codes for the requested Services. BALKANIA OFFICE reserves the right to determine the conditions of use of the discount codes, including but not limited to the duration of their use, the types of Services to which the codes apply and other possible restrictions. In order to use the discount code for the Services, the User shall enter it in the interface where the User selects the method of payment for the Services. If the discount code has not been entered as indicated in this clause of the Rules, it will not be applied to the Services requested by the User.

REPAYMENT CONDITIONS

MONEY REFUND – If the user does not wish to use the money for other press appearances or other services, they can request the money to be returned to their personal account.

BALKANIA OFFICE is not responsible for articles published by users of the platform.

PAYMENT CANCELLATION

BALKANIA OFFICE will notify you immediately if a payment is cancelled. Also, the amount paid will be refunded in full if one of the following situations occurs:

the transaction has not been validated by the payment centre;
the transaction was not accepted by the card-issuing bank;
the terms and conditions of the scheme have not been respected;
orders cannot be fulfilled for reasons outside the control of the BALKANIA OFFICE system, such as Publishers refusing to publish a particular material;
force majeure

Right of withdrawal

Amounts paid into the BALKANIA OFFICE account can be refunded within 14 days from the date of purchase only if they have not been used for the purchase of services. After 14 days, BALKANIA OFFICE does not refund any amount, in full or in part, and the funds remain available in the Advertiser account.

NOTIFICATIONS AND ANNOUNCEMENTS

BALKANIA OFFICE SRL reserves the right to send notifications on the services offered as well as announcements from third parties, when they may be of benefit to users.

BALKANIA OFFICE SRL guarantees the security and confidentiality of the data hosted and transmitted through its computer system. This information may be used by BALKANIA OFFICE SRL to send the user confirmation of requests, various special offers, promotions, etc. only with the consent of the person concerned.

Providing personal data to BALKANIA OFFICE SRL does not imply any obligation on the part of the users, and they can refuse to provide these data in any circumstances and can request their deletion from the database free of charge.

BALKANIA OFFICE SRL, the owner of the online platform, does not intervene directly or indirectly on the databases where information about customers is stored.

According to the requirements of Law no. 679/2016 (GDPR) for the protection of individuals with regard to the processing of personal data, and the protection of privacy in the electronic communications sector, BALKANIA OFFICE SRL is obliged to manage safely and only for the specified purposes, the personal data provided. To this end, BALKANIA OFFICE SRL has developed a series of technical and organizational measures to prevent risks that may arise in the processing of personal data.

In terms of processing, within BALKANIA OFFICE SRL, personal data are processed only for the purposes for which the consent of the data subjects has been obtained, including for parallel purposes and for the conclusion of a contract or the delivery of a product/service to the customer, requested by the latter.

The categories of persons targeted are: current/potential customers or visitors to the website. Exercising the rights provided for by Law 679 / 2016 (GDPR) is fully incumbent on the controller who is also legally obliged to designate a person responsible for processing personal data within the organization.

According to Law No 679/2016 (GDPR), the user has the right of access, the right to be forgotten, the right to portability of information and personal data, the right to intervene on data, the right not to be subject to an individual decision and the right to take legal action. He/she also has the right to object to the processing of personal data and may request the erasure of data. In order to exercise these rights, the user may address a written request, dated and signed to the e-mail address dpo@BALKANIA OFFICE.ro. Also, if some of the user data are incorrect, we are kindly requested to be notified in order to make the necessary corrections.

Site Modification

The Site Administrator reserves the right to modify, at any time and in any way, any section of the Site, according to its own discretionary option, without being obliged to justify in any way the modification, without any prior notice and without being obliged to fulfil any other formality towards the Users.

The Site Administrator may at any time assign to a third party the rights and obligations arising from the provisions of these Terms and Conditions and the Data Privacy Policy, including by assigning to a third party the Contract (Terms and Conditions and Privacy Policy), and the User consents in advance to this assignment, in accordance with the provisions of Article 1315 et seq. of the Civil Code.

We reserve the right to periodically update and modify the Terms and Conditions and/or the ads.mybg.biz.ro Privacy Policy to reflect any changes in the operation of the Service or any changes in legal requirements. In the event of any such changes, we will post the amended version of the Terms and Conditions and/or Privacy Policy on our website and/or otherwise make it available to you. It is your responsibility to be aware of any such revised Terms and Conditions and/or Privacy Policy by checking this webpage. Your continued use of the Site after such revised Terms and Conditions and/or Privacy Policy constitutes your agreement to the revised Terms and Conditions and/or Privacy Policy.

FINAL PROVISION

All users of this site are subject to these Terms and Conditions so accessing this site constitutes acceptance of and compliance with the Terms and Conditions set forth herein. The purpose of data collection is: to provide services according to the current offer.

Any person has the right to object, free of charge and without justification, to the processing of his/her personal data for direct marketing purposes.

According to Romanian law, minors cannot enter into commercial contracts and their personal data is not processed without parental consent.

Non-acceptance of this agreement or of any provision of this agreement shall entail the obligation of the person concerned to immediately cease accessing the site or using the service in any way, and further accessing or visiting the site or using the service in any way shall constitute full acceptance of the agreement and of any provision of this agreement, including any subsequent changes that may be made without restriction by the provider, without any further formality being required.

Users of ads.mybg.biz have the right to purchase and benefit from products and services against payment, from the moment of receipt of payment made in accordance with the provisions of these Rules or under the terms agreed in a separate contract concluded between Balkania Offie and the User.

Prices of products and services vary according to changes in the market, special offers, currency fluctuations and other issues. Information on current prices of products and services can be found whenever you need it in the account created on ads.mybg.biz

The ordered items will be uploaded to the User’s Account within 72 hours from the moment of registration of the User’s request or, from the moment of registration of the Credit in the User’s Account or in the terms established in a separate contract concluded between BALKANIA OFFICE and the User. Subsequently, the User will receive an e-mail in the Account indicating the link to the Article in question.

The website does not assume responsibility for the content of the articles, but only provides technical support for their publication. The Site administrator is totally exonerated from responsibility, the sole responsible for the content of the articles being exclusively the User.
